Terms of Service

These Terms of Service ("Terms") govern your use of the Just Writeweb application (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

The Service provides tools to work with manuscripts and related writing data online (including optional beta reading and questionnaires). Features may change; we do not guarantee uninterrupted or error-free operation.

2. Accounts and eligibility

You may need an account to use certain features. You agree to provide accurate information and to keep your credentials secure. You are responsible for activity under your account. You must be old enough to enter a binding contract in your jurisdiction and not barred from using the Service under applicable law.

3. User content

You retain rights to content you submit ("User Content"). You grant us a non-exclusive, worldwide license to host, store, reproduce, and display User Content solely to operate, secure, and improve the Service for you and, where applicable, collaborators you authorize (for example beta readers invited by a book owner).

You represent that you have the rights needed to submit User Content and that it does not violate law or third-party rights. We may remove content or suspend access where we reasonably believe it violates these Terms or puts the Service or others at risk.

4. Acceptable use

You agree not to:

• Use the Service unlawfully, fraudulently, or to harass, harm, or impersonate others.
• Attempt to gain unauthorized access to systems, data, or accounts.
• Overload, disrupt, or reverse engineer the Service except where applicable law allows.
• Use the Service to distribute malware or unsolicited commercial messages.

5. Beta reading and invitations

If you participate as a beta reader or receive invitations, you understand that book owners may see your feedback and associated account information needed to run that feature. Use such access only as intended by the owner.

6. Third-party services

Sign-in and other features may rely on third parties (for example Google, Meta/Facebook, email providers). Their terms and privacy policies also apply to your use of those features.

7. Paid plans and billing

Some features require a paid subscription ("Plan"). Plans are billed in US Dollars (USD); all prices shown on the Service are in US Dollars (USD) unless stated otherwise. Subscriptions automatically renew at the end of each billing period until cancelled.

Payments are processed by Stripe. By subscribing, you authorize us, through Stripe, to charge your chosen payment method on a recurring basis for your Plan until you cancel. You can view your billing history, update your payment method, and cancel your subscription at any time through the billing portal linked from your account.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR OF THE SERVICE AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY US DOLLARS (US$50), IF YOU DID NOT PAY US.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent allowed.

10. Indemnity

You will defend and indemnify the operator of the Service against claims arising from your User Content, your use of the Service in violation of these Terms, or your violation of law or third-party rights, to the extent permitted by law.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access for violations of these Terms or to protect the Service or users. Provisions that by their nature should survive will survive termination.

12. Governing law and disputes

Unless a different choice is required by mandatory local law, these Terms are governed by the laws of the State of Utah, USA, without regard to conflict-of-law rules. Courts located in that jurisdiction will have exclusive venue, except where consumer rights require otherwise.

13. Changes

We may modify these Terms. We will post the updated Terms and update the "Last updated" date. Your continued use after changes become effective constitutes acceptance of the revised Terms where permitted by law.
